What is a Sale and leaseback?
Sale and leaseback is a scheme whereby a senior citizen sells their home and receives a monetary sum in exchange. Despite the sale, they retain the right to continue living in their home for life or for as long as they wish, by means of a rent-free tenancy agreement.

Advantages and guarantees of a Sale and leaseback plan
Sale and leasebacks are formalised by means of a public deed before a notary public, which guarantees maximum legal security. After the sale, you will get a lump sum payment and also retain the right to continue living in your home thanks to a rent-free tenancy agreement, with full guarantees and at no additional cost to you.
The tenancy agreement, which comes into force at the time of sale, is also notarised and registered in the Land Registry, which guarantees the senior, in accordance with the provisions of the Urban Leasehold Law (art. 13.1. LAU), that neither the purchaser nor those who may have future rights over the property may terminate the agreement or amend its conditions.
The tenancy agreement is drafted by lawyers specialising in this type of transaction who will ensure that it complies with the requirements of the LAU (Urban Leasehold Act) and look after your interests from start to finish. We also ensure compliance with all legal requirements, including the payment of the Property Transfer Tax and the posting of a security deposit with the relevant regional authorities.
Under a Sale and leaseback plan, you will no longer have to pay property tax, homeowners’ association fees, extraordinary levies or building insurance for your home.
